HSUS bragged and bragged they helped take down big time legends of dogfighting. HSUS helped get every dog killed, yet the people could not get a conviction on the Boudreauxs. They did the same to the Pat Patrick dogs, killed every single one. The people (AZ) could not get a conviction on Patrick. Another case coming up in March 2009, they already killed every one of that person’s dogs as well. I seriously doubt that guy will be convicted of anything.

Petdefense// It should be noted that the existing Louisiana law does not call for the preservation of “evidence” (such as dogs) in charges relating to alleged dogfighting.
Instead, it states that the animals can be killed ASAP, by claiming that such animals (even without any type of proof, apparently)–are “contraband” and therefore they can be killed immediately. [I find this to be patently illogical, as I cannot see the contraband claim unless there is a criminal conviction; the mere ownership of the dogs does not make them contraband without more.]
The word contraband normally refers to the “illegality” of a particular item, such as illegal drugs, illegal weapons, illegal substances and the like. Other than the “illegal” item itself, exactly how does the city, state or county government *know* that a “dog” is “contraband” unless it can prove it first? Apparently they don’t need to know, because they don’t need to prove anything. Florida in particular, has had a lot of problems with their “contraband” forfeiture cases.

Does that mean if someone complains that YOU own or YOU sell dogs for a living, and you have more than 25 in your kennel, that on probable cause such as HSUS spys out on the internet, say that you can buy a “fighting” dog from Mr. X in Louisiana, that the police can get the HSUS involved, the ASPCA involved, and a SWAT team, and descend upon your property with a warrant, round up every dog and kill it, and not proceed to trial for 3-4 years, and then when trial day comes, the Judge finds that there is not even enough facts or evidence for any type of conviction, and that no charges of animal cruelty were filed?
Let’s be realistic here folks. Vick was guilty because he admitted he was guilty. Plus he had people rat him out. But I am not talking about Vick. And in Vick’s case, where he ADMITTED guilt–they DIDN’T kill the dogs. Instead, most of them are in dog rescues and several are at the Best Friends sanctuary which has the website “dontbuypuppies.com.” (Yes, Best Friends, HSUS and ALDF all say NOT to buy a puppy, of any type, or a dog. Period. )
I have reviewed general law regarding contraband and forfeiture. It seems in 2000, a group of attorneys finally got a Federal amendment passed so that “forfeiture” laws would have less abuse by law enforcement agencies.
It was and still is a concern, because many assets are still seized from innocent people who are never convicted, and the assets are never returned.
In fact, indigent clients are supposed to be advised that a court appointed attorney is available re the forfeiture, but many are never advised. Forfeiture cases usually require knowledge of criminal law, criminal procedure, constitutional law, real property ,civil procedure and civil law in general. It is very specific and few attorneys specialize in it. Probably due to that reason, many people lose their property even though they are not guilty.
It is for that reason, that HSUS has sought to become involved in quasi-legal police enforcement, and has aligned itself with law enforcement. HSUS wants to take proceeds from forfeiture CASES by passing laws which would enable them to
(a) Work with law enforcement and
(b) Be set up to take part of the forfeiture proceeds when they “BUST” a case such as “dogfights” or any other type of “SWAT” case they can get their hot little hands upon.
As Rep. Henry Hyde (R-Ill.) points out in his 1995 book Forfeiting Our Property Rights, “In more than 80 percent of asset forfeiture cases the property owner is not even charged with a crime yet the government officials can and usually do keep the seized property.”
Civil forfeiture is actually this: a backdoor to get around constitutional protections– that begs for abuse. The notion that property can commit crimes is absurd. (Cars don’t solicit prostitutes; people do.) Forfeiture can be a valuable weapon in sucking the profits out of a criminal enterprise.
But the fair way to seize these is through something already on the books called criminal forfeiture. This procedure requires a criminal conviction before seizing property, eliminating much of the injustice of civil forfeiture.

It is no secret that HSUS not only participated in raids, they sent in people to start ALL of the action against any large dog kennels…… and in AZ, HSUS people were interviewing minor children to turn evidence against the parents….HSUS even has a video of HSUS people AT the dog raid. and they put it on U Tube to boot!!
The Pat Patrick case (AZ) resulted in an acquittal. (Not surprised are you?)
HSUS attempted to pass one of their little “forfeiture” laws in CA and claimed the “local” ASPCA would gain from forfeiture proceeds, but we all know HSUS would as well. After all, they proposed the law. HSUS has taken over other Large non profits, and is now working side by side the ASPCA. WP of the HSUS makes no bones about being a “powerhouse” in control of the AR movement. What is very bad about the HSUS?
Well, if I had an agenda to stop all the breeding of dogs-like HSUS—-it might not go over very well. But if I could find an example of a kennel where I could make the kennel look bad on TV—and then tell everyone that all purchased dogs come from a kennel just like this one— would I be telling the truth? Of course not! But that is what HSUS does.
HSUS clearly has a strategy of gathering together a group of other AR non profits and merging them with HSUS, which they have done. The goal was obviously to make strides by gaining more $$ from using the donations of ALL the combined groups. Then use the $$ to make political advances by using the media.
They make videos with sappy music, and words on the screen alluding to people abusing, abusing, abusing animals, without anything more, then they claim to be the big rescuers for abused animals. You put that together with the video about the dogs and that equals HSUS. When one MISLEADS another, that means they are lying, and that is misrepresentation.
Take all the good dogs from commercial kennls, as long as you find alleged “not taken care of” dogs. Then SEIZE everything and before anyone can fight BACK, the dogs have all been sold to people through shelters/rescues.
I can tell you first hand, I know what swat teams and AC people do. They lie a lot. They will “investigate” and MAKE UP CRAP —just like on TV. They will take dog poop out of the garbage, and then put it in the house and smash it all over the place, and then CLAIM it was that way when they went inside. Then they take pictures.
Now how would you prove that you DIDN’T DO IT? Maybe that isn’t clear to enough people. That type of insanity is done so they can TAKE everything you have.
It is my opinion that if a kennel is operally legally, then they should be allowed to engage in business. Same for a petstore.
HSUS is against ANYONE making any $ from selling any animal, YET HSUS is making tons of $$ by misleading people, in soliciting donations for causes.
Such as Katrina pet rescue (HSUS has not accounted for where the $$ all went–perhaps swallowing up those other rescues gave them more work and they lost their records?)…..HSUS solicited for donations for the Vick dogs when HSUS didn’t even HAVE custody of the dogs AND claimed all the dogs should be killed……..(WOW that’s pretty misleading isn’t it??)….HSUS hires convicted felons and even has fundraisers for them?? (12/13/08 HSUS just had a fundraiser for convicted eco terrorist) HSUS purposely hires shelter workers who are wacked out, convicted felons…..people who will stop at nothing to get their agenda across. Even if it means advocating that no one should be able to buy a dog, by misrepresenting and categorizing all dog breeders as bad, unethical, and immoral. Translation: Buying a puppy means you are immoral and bad, and that you abuse animals.

Do not ignore the sugar coated pill of Wayne Pacelle. He is glib and clever. But not honest. Beware. Stand up for your rights before you don’t have any left—–tell everyone you know, even NON pet owners–what HSUS is all about. A BIG sugar coated PILL.
It’s called political agenda, money, and lies. Not animals, or the truth.
