Notice that in the lawsuit, the Judge carefully delineates the “standing” required in Federal Court.

We are not familiar with the prior lawsuit documents, so we cannot tell for sure if there was standing prior to getting this far in the case.  Nevertheless the attorneys say they are appealing. An appeal normally means there is an error of law or an abuse of discretion. It remains to be seen how they plan to lay out the appeal.
