Petdefense has been writing about these laws for months—in particular, AB1122.
AB1122 takes legal conduct, and makes it illegal, and calls it “animal abuse.”
The legal conduct?
It’s called “SELLING AN ANIMAL”, PEOPLE!!!
Few other than Petdefense and Wethepeople and Petpac,
seem to realize that SELLING an animal
is NOT “animal abuse”……WHY is that???????
Where are CDOC, NAIA and the rest????
WHERE ARE THEIR ATTORNEYS AND WHY AREN’T THEY FURIOUS???????
Why is selling an animal called “animal abuse”
but if a shelter or rescue sells an animal, it’s “NOT” ANIMAL ABUSE????
Very quickly: When laws like this get passed, and people don’t object,
we get what? We get laws that set precedent–meaning,
we have AR laws that can spread like cancer, and will be
used to duplicate the laws elsewhere. Like in all other states?
THERE IS NO WAY IN THE WORLD
THAT SELLING CAN BE ‘ANIMAL ABUSE’ IN THE LAW,
BUT– IF A RESCUE/SHELTER/HUMANE SOCIETY DOES IT,
IT IS “NOT” ANIMAL ABUSE?

The proposed “law” means selling is illegal—
but selling by rescues is NOT illegal.
Woe unto all those who don’t understand the legal
significance of this egregious, horrific, insane so-called “LAW.”
Animal fanciers may think it doesn’t apply to them… WRONG!!
It will most certainly apply, because it sets up the “law”
which means selling is illegal. But rescues SELLING is not illegal!!!
ALL selling, whether by owner or rescues,
involves interstate commerce.
It does not matter if $$$$ is involved, as each animal
will require food, supplies, toys, services and more.
Multiply that by 10 million animals sold on Petfinder online, and
it becomes QUITE CLEAR what we are saying?????
Below is a summary of why these California laws are all bad, all trigger another law, seizure, forfeiture; most of them make legal conduct illegal (making the conduct criminal in most cases), and most of them are set upon doing several things:
Penalizing innocent conduct, Penalizing intact dogs, Penalizing feral cats, Penalizing people who feed feral cats, Making selling of an animal illegal for anyone except rescues and several small other exceptions, when the animal is transferred in a public venue, right of way, park, beach, animal dog park (while you are showing how good the animal gets along with other animals), parking lot of any type, kind, or location, even if it’s your own parking lot. It would also be illegal on the sidewalk, in a pet store parking lot, your Denny’s parking lot, the library community gathering area outside, or other public area, or even a private lot such as the Lexus dealership, or the Tractor Supply pick up area outside. All of these public areas are used to rehome animals by owners, since they prefer not to have people they don’t know, at their homes. Can we blame them?
Most citizens are not even aware this is going on. We have randomly gone to strip malls, large shopping areas, major retail stores, and even to petstores, asking people if they understood, or even knew about these laws. None of the people knew anything except one gal, who had heard from her cousin, that feeding feral cats might become illegal, and she knew about TNR.
That was the extent of knowledge we found after asking 15 people. But one thing we did notice, was that they were taken aback when the laws were explained. None of them liked the laws. We believe that giving legislators data, facts, and the truth often just falls on deaf ears. They either do not care about the public they serve, or do not want to know. They just keep passing more and more and more garbage laws. They all cannot be that stupid. Which indicates something is going on. It’s called politics. Or payola.

Not one of these laws is worth the paper it’s written on, the amending of the laws is done in a non standardized format (by the government) online, making it very difficult to decipher, and the amendments have made the laws worse, not better. The Dept of Finance has opposed AB1122, SB250, and AB241, which are 3 of the worst bills.
Contact Governor’s office and fax in your opposition letter. He has until October to veto from what we understand. Instead of listening to the public and those who actually understand these laws, the legislators instead PASS them. This shows either stupidity, or payola, or someone wants their campaign financed by AR money.
All of the legislators who voted yes on any of these laws should be eliminated.
