Apparently yes……….so says news articles ………at a Pet Smart Store….
Our question has always been…knowing that pet stores allow dogs (and other animals) to be brought inside the store, if owners actually bring their dogs, let’s say, into the pet store, and your dog is actually killed right in front of you by another customer’s dog, is it somehow the pet store’s fault that your dog was killed?
Since we were not there when it happened, and we don’t know the animal laws in the actual jurisdiction, we could try to pretend that IF it happened inside a similar store in California, what might be the result?
In California, there are state animal laws, and then local animal laws. In some counties, a dog that causes harm to a person or another animal under certain conditions, is presumed to be potentially dangerous or even dangerous. In some instances, if this has happened before, the dog may face euthanasia. In other instances, it might depend upon what each owner was doing with each dog at the time it happened prior to the altercation.
There can be some possible defenses for the owner whose dog attacked the second dog in some cases, which depends upon the exact circumstances. In other areas, there may be immediate impound simply because the animal attacked or killed the second animal.
Any time an animal kills or attacks another animals (and especially if the word animal is not defined…) there are always issues involved that one might not realize. Some of the issues may involve tort related theory and local jurisdiction issues. Possibly, it could involve owner criminal related animal laws.
(the above purportedly wonderful dog killed the baby it lived with…but ARs saved the DOG, the baby was already dead………..) Numerous dogs have killed kids, and ARs rush out to save the DOGS— repeatedly– like we said– ARs never blame the animals.
If you live in a rabid AR area, the laws are usually against the animal owners. If you don’t live in a liberal AR area, local rules might be more in the owner’s favor. For example, you cannot even breed or buy animals of your choice in some areas, but in others, you can breed or buy anything. The state laws on animals killing people and other animals or livestock are quite varied nationally. Fault and no fault and negligence and strict liability are not used or applied the same (nationally) with regard to animals and the harm that may come about.
Therefore if you as an animal owner want to protect yourself, it’s always best to find out the law in advance locally, always be pro-active, and always assume that some stupid AR owner with their shelter, rescued or nothing known about their pet attitude— will be the one to create a problem. They are usually the problem because they believe everything they see on TV, Animal Planet, and AR propaganda online.
If you don’t believe us, consider that:
AR owner put kid in trailer with 3 dogs in locked cage, dogs escaped/killed kid.
AR owner obtained white bulldog type dog that had been beat up by other dogs, was fence fighting other dogs, and was already sick; owner entered animal’s cage area, was savagely attacked, her throat nearly crushed, arm/leg severely mauled; she managed to call 911 and amazingly survived. This rescue owner is someone we knew– she quit rescue forever and moved away.
AR rescue volunteer foolishly and stupidly kept 5 large dogs in the living room, had little to no experience with dogs apparently (else why would any imbecile even do this) and they mauled her to death.
AR dog owner bought rescued unknown puppy from shelter, knew nothing about dogs, or training them, or dog behavior, walked dog outside without leash, dog repeatedly would attack other dogs….after the 4th attack, dog owner contacts attorney (one of our attorneys from blog) to defend on dangerous dog charges. Luckily the dog had not yet killed an animal or person. Not yet anyway.
AR dog owner already had a dog, adopted more from shelter, then ended up with like 5 pitbull mixed (no one knows exactly)….owner leaves toddler inside house, where the dogs were inside a garage; supposedly the door to garage was not locked and child got into garage, was mauled to death? Owner went to jail for a year.
AR owners BOUGHT unknown breed dog from rabid AR well known san diego area animal shelter, allowed the dog to sleep in their bed with their new baby; dog bit child’s head and killed it. Animal humane place claims they didn’t see any prior action that would indicate it was a vicious dog?
EVERY SINGLE ONE OF THESE INCIDENTS WAS CAUSED BY HAVING BOTH AN AR ATTITUDE, AND BEING JUST PLAIN FREAKIN’ STUPID TO BOOT. THE AR ATTITUDE IS THAT IT’S NEVER THE ANIMAL’S FAULT. THE TRUTH IS THAT HARM CAN BE CAUSED BY ANIMALS, REGARDLESS—- THEREFORE IT IS COMMON SENSE TO DO OR NOT DO CERTAIN THINGS WHICH MIGHT CAUSE HARM TO P E O P L E.
And as an aside, we would NEVER bring a pet to a pet store.
